1. SUBSCRIBER USE
The following terms set out any use of The Pointer by its subscribers. Anyone who enters into a subscription service, under these Terms and Conditions is legally bound to The Pointer and agrees to abide the rules of this policy. Anyone who does not agree with the conditions of this policy, including its Privacy Policy should not subscribe to The Pointer.
2. SERVICE UNDER SUBSCRIPTION AGREEMENT
Subscribing to The Pointer limits access to its content to one user. The user's subscription and reader account is registered, under one name, with The Pointer. Any use of a single subscriber account to share The Pointer’s published content on any other publishing, broadcast or social media platform is strictly prohibited.
The Pointer is not responsible for the sharing, in any way, of its content with minors. Any such decision rests with The Pointer’s subscribers.
The Pointer has the right to terminate or suspend any subscriber account if it is determined that the individual has, or has attempted, to share their login access with another individual, group, or business entity. The Pointer has the right to terminate or suspend any subscriber account if the individual has or has attempted to share the Pointer’s content on any publishing, broadcast or social media platform without prior consent from The Pointer. This does not apply to the republishing or broadcasting or linking of The Pointer’s publicly available content from its homepage, unless such republishing or broadcasting or linking is done without proper reference and credit to The Pointer as the source of its original content.
3. FEES AND BILLING
The Pointer charges a standard $10.00 CDN monthly subscription fee to all users. The fee is automatically processed by a third party which handles all payment transactions. The Pointer has no role in the payment transaction between subscribers and the third party vendor, nor does it have any ability to access payment information between its subscribers and the third party vendor. The Pointer is obligated to provide subscribers with the ability to cancel their subscription at any time. The full monthly cost will be charged up to the end of the month that the subscription is cancelled in. The subscribers are required to provide all current and proper billing information under this Agreement.
4. COPYRIGHT AND TRADE-MARK
The Pointer’s content made accessible to subscribers under this Agreement including text, photographs, audio recordings, video recordings, illustrations, and graphics is protected by the Canadian and International intellectual property laws. All copyright and trade-mark laws protect The Pointer’s published or broadcast content. The registered name (“The Pointer”), the domain, “thepointer.com”, all of the logos and other business trade names and designs of The Pointer are the registered trade-marks of The Pointer and its owners. They are protected from any reproduction or misleading use. The use of The Pointer’s content, logos, trade-marked material without the explicit consent of The Pointer is strictly prohibited.
5. USER CONTENT
Subscribers may submit their own original content to The Pointer. Subscribers are solely responsible for any material submitted to The Pointer. The Pointer will determine if such content for publication is allowable under its journalistic standards. Any material submitted by subscribers is done so with the understanding that the subscriber is the copyright holder of the material. Subscribers will not submit or attempt to submit any content to The Pointer that is obscene, promotes hatred, is defamatory, libellous, indecent, harmful to minors, false, misleading, threatening, demeaning, sexist, racist, discriminatory; or in any way infringes on the legal rights of others, or infringes any intellectual property rights including copyrights, trade-marks, proprietary rights, privacy rights, publicity rights or any other rights of any kind. Subscribers will not, under this Agreement, submit or attempt to submit any material to promote or conduct commercial activities of any kind. Subscribers will not submit or attempt to submit any material including material related to any computer hardware or software or online platform or digital platform that in any way could damage The Pointer’s website or any of its online or digital or publishing infrastructure.
6. RIGHTS OF SUBSCRIBERS
Subscribers have non-exclusive, limited rights to access and use The Pointer’s content under this Agreement, for personal, private and non-commercial use. Without the express consent of The Pointer, subscribers or anyone else that has access to The Pointer’s content may not use it for any commercial purpose. Subscribers and anyone else who has access to The Pointer’s content, may not repackage, repurpose or recreate in any other form in whole or in part The Pointer’s content for any commercial use.
7. DISCLAIMERS
Content on The Pointer’s platform(s) is for general information only, the content is not necessarily representative of The Pointer, its policies, its owners or its staff. The Pointer cannot guarantee the accuracy or reliability of the content on any of its platforms.
8. LIMITATION OF LIABILITY
All subscribers and anyone else viewing in any way, in part or in whole content on The Pointer’s platforms understand that The Pointer in no event will be responsible or liable to the subscriber or anyone else (jointly or severally) for any claim, loss or damage whatsoever, including without limitation any direct, indirect, incidental, exemplary, special, punitive or consequential damages or any damages for loss of profits, savings, revenue, goodwill, business interruption, loss of information or data or other intangible losses, arising from, or any way connected with the content of The Pointer or any of its platforms.
9. INDEMNITY
Under this Agreement, subscribers or anyone else accessing the content on The Pointer’s platforms will indemnify, defend and hold harmless The Pointer and each of its officers, directors and employees from and against any and all claims, actions, losses or demands, including without limitation reasonable legal and administrative and accounting fees, resulting from or relating to any breach of these terms and conditions or subscription Agreement.
10. TERMINATION OF USER ACCOUNTS
The Pointer has sole discretion to terminate any and all user accounts or subscriptions for any reason or reasons.
